#1. Title Verification
Before I start to share the lessons I learned in title verification before buying real estate I would like to acknowledge Mr. Cesar Santos, for this lesson came from his lectures where I am a student. The following are the general action steps you need to do in order to verify real estate titles.
First, secure a photocopy of the certificate of title from the registered owner (owners duplicate copy) or authorized representation of the owner.
Secondly, check the existence of the original copy of the above title at the registry of deeds with jurisdiction over the property. Better get a certified copy of the title.
Thirdly, check annotations (ex. Liens and encumbrances) at the back of the original title which may not be appearing in the owners duplicate copy.
Here’s a nontraditional way in checking the validity of title but it works, hold the certificate of the title against the light (original and owners copies if possible) to verify if it bears security marks or water marks such “NLTDRA” or “LRA”.
Then, the last two digits of the title number should be the same as the last two digits of the page number found at the top right portion of the title. After that verify from the Land Registration Authority if the serial number (upper left side portion) corresponds to the series of titles assigned or allocated to the registry of deeds which issued the title.
Then verify from the Land Management Bureau (formerly Bureau of Lands) or the Land Registration Authority, for survey plans approved by them if the survey plan number indicated in the title corresponds to the region where the property is located.
After doing that verify from the Entry Book of the Registry of Deeds if the contract of sale or conveyance which was the basis for the issuance of the subject title was recorded in said entry book on the date and time stated on the face of the title.
